Terms and Conditions for Subtoco Property Services

It is essential that the limitations and terms of service are understood and agreed before engaging our services. Booking our services presumes your agreement to these terms.

1. Service Overview

The primary objective of our services is to support the presentation of properties for sale or rent by offering 2D floor plans, property photographs, or 3D virtual tours. Each service is delivered to a professional standard. 

2. Scope – What the Service Includes

i) A Site Visit. A site visit will be conducted in conjunction with other relevant services such as BER assessment, 2D floor plans, or 3D virtual tours.

 ii) Specific Deliverables: –

  • 2D Floor Plan: A floor plan for the specified property or unit (e.g., apartment), excluding unattached garages or outbuildings. 
  • Property Photographs: Photographs of the property, including optional aerial photos if booked in advance and legally permissible. 
  • 3D Virtual Tour: A virtual tour of the property, which may include common areas for apartment units. 

3. Client Obligations

i) Clients must understand and accept these terms and conditions, including limitations, to book these services. 

ii) Provide access to all rooms, where applicable.

iii) Ensure the property is staged and cleaned before the site visit.

iv) Keep areas free from people, animals, personal items and vehicles.

4. Limitations of Service

4a. General Limitations

i) The services are available for use by and available through selling agents.

ii) Services include one visit to the property only. Additional visits may incur extra fees.

iii) All measurements and dimensions are approximate and intended for general informational purposes. They should not be relied upon as a substitute for professional advice or accurate surveying.

iv) In the case of an apartment/duplex/maisonette the service applies to the specified unit only and may not include common areas or blocks.

v) Services do not include staging, cleaning, digital staging or photo editing.

vi) Aerial photography is not included as standard. Aerial photography may be included for an additional fee where booked in advance and where the location of the property is in a legal flight zone.

4b. Specific Limitations

i) 2D Floor Plan: Produced by a third-party provider, and therefore is dependent on the availability of the digital file from the provider. The floor plan is intended for illustrative purposes only. Garages and/or outbuildings which are not attached to the main building will not be included in the floor plan.

ii) Property Photographs: Photograph selection is at the photographer’s discretion. 

iii) 3D Virtual Tour: Produced by a third-party provider, and therefore is dependent on the availability of the digital file from the provider.

5. Price and Payment

i) The price of services will be determined on request. The price includes VAT at the current rate.

ii) Payment can be made by credit card, debit card, and Electronic Funds Transfer (EFT).

6. Delivery of Service

i) Deliverables are issued by email to the email address advised by the client at the time of booking. The email will contain a link to a secure site.

ii) Floor plans are provided in JPG format only.

iii) Deliverables issued within 5 working days of the inspection date, subject to availability of the digital file from the third-party provider, where applicable.

iv) Deliverables – 2D Floor Plan, Property Photographs, 3D Virtual Tour – available to view for 3 months from the date of issue.

7. Data Protection

We adhere to GDPR and other relevant data protection laws. Personal data collected will be used solely for the purpose of the survey and will not be shared without client consent, except as required by law. Data will be stored securely and disposed of responsibly when no longer needed. 

8. Consumer Rights

Clients retain all statutory rights as prescribed under consumer protection laws and the Consumer Rights Act 2022, however, clients are required to consult with their legal advisor to fully understand and accept the extent, limitations and exclusions of this service before exchanging contracts.

9. Liability, Confidentiality, and Ownership

i) Liability is limited to a maximum amount equal to the fee paid for the service.

ii) Ownership of the service deliverables passes to the client upon receipt of full payment.

iii) Property Health Check Ltd. (PHC) retains the full worldwide copyright of all images taken. We reserve the right to use images for self-promotion, editorial use on the company website(s) and social media, unless otherwise agreed with the client.

10. Complaints Policy

i) In the event of a dispute, clients are required to contact us directly for resolution. Review our complaints policy here.

By booking and paying for this service, clients acknowledge and agree to be bound by these terms and conditions.

13. Termination

i) The Client may terminate an Agreement but must give a minimum of two working days’ notice.

ii) If a cancellation or a postponement takes place within two working days of the inspection, then 25% of the quotation total fee will be charged.
